Van Nuys DSO: What you need to know to save your license.

The Van Nuys Driver Safety Office is located in the Van Nuys State Government complex on Van Nuys Blvd. and is an office responsible for adminstering APS hearings, “P & M” hearings and Negligent Operator hearings. DMV hearings are not informal meetings, they are legal proceedings that have an impact on someone’s ability to drive, impacting their freedom. It is important to know your rights if you are facing a hearing at any DSO office.

APS Hearings:

APS stands for “Administrative Per Se” and is the DMV hearing proceeding for driver license suspensions following DUI arrests. In the state of California, the DMV has authority to suspend someones’ license if they are found to have operated a motor vehicle with a blood alcohol level at or above 0.08%. The issues presented in an APS hearing are:
-Was the driver lawfully arrested
-Was the driver operating a motor vehicle on public roadways
-Was the driver’s blood alcohol level at or above 0.08%
The DMV must prove each of these issues at the APS hearing in order to suspend the driver’s license.
The consequences of an APS suspension range from 4 month suspension to lifetime suspension depending on:
-The Driver’s driving record
-Whether the Driver refused to submit a chemical sample of blood or breath to law enforcement

P and M Hearings:

P & M hearings are conducted when a driver has exhibited physical or mental conditions that can effect their ability to safely operate a motor vehicle. The issues examined at a P and M hearing are:
-The Driver’s prior driving record
-The medical condition of the driver
– Whether the driver can get a doctor to certify that they can safely operate a motor vehicle
P and M suspensions are often for life, or until the underlying medical condition has been corrected.
